General Terms and Conditions of Sale
Travel contract: any contract under which one party undertakes, in exchange for payment, to provide another party with either a travel package contract or one of the separate services that make it possible to undertake any trip or stay.
In order to proceed with the booking and purchase of the services, the customer/tourist/user/travel agency is required to read and expressly accept in full, by ticking the relevant box or clicking the hyperlink provided for this purpose, these General Terms and Conditions of Sale as well as any special conditions applicable to individual services.
If the General Terms and Conditions of Sale and the special conditions applicable to individual services are not accepted, it will not be possible to confirm the booking or purchase those services.
The General Terms and Conditions of Sale applicable to the sale of the services are those published on the website on the date of purchase and displayed and accepted during the purchase procedure.
The General Terms and Conditions may be amended at any time by Alltrade Business Srl without prior notice, provided that such amendments shall not apply to purchases of services made before the amendments took effect.
Before proceeding with the purchase of the tourism service, the user must therefore read and accept the terms and conditions set out herein.
Alltrade Business Srl is a tour operator acting as an intermediary for tourism services provided by third parties (hotels, tour operators, hotel management companies, local DMCs, transport companies). Under no circumstances shall Alltrade Business Srl be held liable for the obligations of the providers of the individual products and/or services, pursuant to Article 22, paragraph 3, of Law No. 1084 of 27 December 1977, ratifying and implementing the International Convention on Travel Contracts (CCV), signed in Brussels on 23 April 1970, under which “the intermediary shall not be liable for the total or partial non-performance of trips,” as well as pursuant to Legislative Decree No. 206 of 6 September 2005 (Consumer Code).
In its capacity as an intermediary of tourism services, Alltrade Business Srl shall not be liable for the total or partial non-performance of trips, stays, or other products and/or services that are the subject of the contract concluded between users and the third-party provider (hotel, tour operator, hotel management company, etc.). With regard to the purchase of the tourism service, the liability of the third-party provider shall be governed by the contract entered into by that provider with the user, as well as by the applicable law.
With regard to the accuracy and updating of the information published on its website concerning the tourism services described and offered, Alltrade Business Srl shall not be held liable for any inaccuracies, errors, or untruthful statements (in particular with regard to: description of the offer, accommodation, distance from and accessibility to other tourist locations and/or the means of transport chosen by the user, services payable locally, etc.), as such information is provided by third-party suppliers of the tourism services.
Hotels, tour operators, hotel management companies, and, in general, any third-party provider of tourism services are independent businesses and are not representatives, agents, or employees of Alltrade Business Srl.
Any booking and/or combination of different products and/or services provided by Alltrade Business Srl is made entirely at the user’s discretion, and the user therefore assumes all responsibility arising from any such combination of services. Accordingly, Alltrade Business Srl shall under no circumstances be liable for the incorrect entry of users’ personal data during the purchase process. The user is therefore responsible for any consequences arising from incorrect data entry and must verify, prior to purchase, the information relating to the tourism service purchased.
Any seller who undertakes to procure for third parties, including by electronic means, a standalone or combined tourism service is required to provide the tourist with the documents relating to such service, showing the amount paid for the service, and may not in any way be considered a travel organizer.
The organizer and the intermediary of the package travel or individual tourism service to whom the tourist applies must be duly authorized to carry out their respective activities in accordance with the applicable administrative regulations, including regional regulations where relevant.
Pursuant to Article 18, paragraph VI, of the Italian Tourism Code, the use in a company name or business name of the words “travel agency,” “tourism agency,” “tour operator,” “travel intermediary,” or any other similar words or expressions, including in a foreign language, is permitted exclusively to businesses authorized pursuant to paragraph 1.
The purchase of stays/travel services through the websites of Alltrade Business Srl may be made in the following ways:
Buy online by paying 100% of the amount due using one of the available payment methods if there are fewer than 10 days before the start of the stay. The booking request for the travel service is completed entirely through the website: the customer/tourist/user/travel agency (the latter paying 100% by credit card if there are fewer than 5 days before the start of the stay) must provide all the information necessary for the purchase (first name, surname, email address, etc.), together with the details of any other travelers and the information relating to their credit/prepaid card. Once the purchase has been made by the customer/tourist/user/travel agency, Alltrade Business Srl will verify the availability of the services selected by the tourist and their corresponding price, and will send the tourist/travel agency a confirmation email containing the details of the purchase. Any details not reported correctly must be notified immediately by the tourist to the Booking Office by calling the number indicated in the confirmation email. If the tourist/travel agency makes an error when submitting their data, Alltrade Business Srl declines all liability for the non-performance or incorrect performance of the trip due to failure to receive the travel documents.
Secure your stay online by paying 30% by credit/prepaid card, with the balance payable by bank transfer (if the booking is made by the customer/tourist, they may choose whether to pay the balance at the travel agency or directly to Alltrade Business Srl). Alltrade Business Srl offers the possibility to secure the stay by purchasing online through a binding purchase proposal for the tourist. The customer/tourist/user must provide all purchase details (first name, surname, email address, etc.), together with those of any other travelers and the details of their credit/prepaid card. Once the customer/tourist/user has paid 30% of the amount relating to the selected service, Alltrade Business Srl will verify the availability of the services selected by the tourist and their corresponding price, and will send the tourist a confirmation email containing the details of the purchase, as well as the date by which the tourist must pay the balance for the selected service by bank transfer, including all the information necessary to make the transfer. If the booking is made by a travel agency, the only difference from the above is that it will not pay the deposit, but will instead pay the full balance directly by credit/prepaid card or by bank transfer within 15 days of the start date of the stay.
Book by calling the Alltrade Business Srl Booking Office. The tourist/travel agency may book the travel service/stay by contacting the Booking Office and may pay for the selected service in full and/or in part by credit card or bank transfer depending on the departure date. During the purchase process, credit/prepaid card details are required: if any problems arise (for example, lack of bank authorization or insufficient funds), the purchase will be suspended. In this case, no charge will be made to the tourist/travel agency, but they will lose the fare that had been held during the purchase process. The credit/prepaid cards indicated on the website footer and at the time of purchase are accepted. Failure to pay the above amounts to the organizer by the established dates shall constitute an express termination clause, entitling Alltrade Business Srl to terminate the contract by operation of law.
IMPORTANT: All bookings made through this website are to be considered unconfirmed until the actual availability of the booked services has been verified. You will receive a further confirmation email in this regard (separate from the one automatically sent upon completion of the booking procedure). If the services are not available on the dates you selected, we will contact you to find an alternative solution. If it is not possible to confirm the requested booking, the full amount paid for the booking will be refunded immediately.
After confirmation of the completed purchase, the electronic travel documents will be sent by email to the address provided during the purchase process, or to the travel agency if the booking was made through the agency and the customer/tourist has chosen to pay for the stay/tourism services through the travel agency.
Alltrade Business Srl relies on the accuracy of the information provided and therefore cannot be held liable to the customer/tourist/user/travel agency for failure to deliver travel documents due to an incorrect email address or improper email software configuration. It is the responsibility of the customer/tourist/user/travel agency to promptly inform Alltrade Business Srl of any changes to their email address or telephone contact details.
In addition, the customer/tourist/user/travel agency is requested to verify that the details shown on the travel ticket and/or booking confirmation (first name, surname, etc.) are correct. Travel documents are delivered by email.
Furthermore, in order to complete the personal details of the lead passenger or booking holder, the date of birth and address, or alternatively the tax code, will be required.
The official classification of hotel establishments published on the Alltrade Business Srl websites is provided on the basis of the express and formal indications issued by the competent authorities of the country in which the service is delivered. In the absence of an official classification recognized by the competent public authorities of the countries, including EU Member States, to which the service refers, the organizer reserves the right to provide its own indicative classification of the accommodation facility, so as to allow the tourist to assess and consequently accept it.
Although, under the above-mentioned legislation, Alltrade Business Srl is not liable for the total or partial non-performance by the third-party provider of the tourism service (see point 29, Liability), it will nevertheless promptly inform the user of any changes communicated by the third-party provider of which it has been made aware. In any event, Alltrade Business Srl shall not be liable for any compensation for damages resulting from cancellation, modification, or any other act attributable to the third-party provider, or arising from force majeure.
The customer/tourist/user/travel agency has the right to withdraw from this agreement by sending a written notice by email to alltradebusiness@pec.it. In such case, the following percentages of the participation fee will be charged, calculated according to how many days before departure the cancellation is made:
- From the booking confirmation up to 31 working days before departure: 30% of the participation fee
- From 30 to 21 days before departure: 50% of the participation fee
- From 20 to 5 days before departure: 90% of the participation fee
- After this deadline: no refund
No refund shall also be due to the customer in the following cases:
- Failure to arrive at the accommodation on the scheduled arrival date or at the departure airport (no-show)
- Interruption of the trip or stay
- Inability to travel due to missing or irregular identity documents, or failure to comply with any other requirement necessary to undertake the trip (verification of the validity of travel documents is a personal and non-delegable responsibility)
The customer/tourist/user/travel agency is responsible for the accuracy of the information entered in the booking. Alltrade Business Srl cannot be held liable if, as a result of errors in the data provided, the customer/tourist/user/travel agency is unable to make proper use of the travel services.
Alltrade Business Srl shall not be liable for any compensation for damages arising from cancellations or changes to travel services caused by force majeure. Such events include, by way of example and not limitation, wars, terrorist activity, nationwide strikes, fires, epidemics, hurricanes, and other actual or potential serious environmental disasters.
The customer/tourist/user/travel agency must also comply with the rules of normal prudence and diligence, as well as with the regulations in force in the destination countries, and with any administrative or legislative provisions relating to the travel package.
The customer/tourist/user/travel agency shall also communicate in writing to the organizer, by email or by telephone using the contact details indicated in the booking, any specific personal requests that may form the subject of specific agreements regarding the travel arrangements, provided that they can be implemented.
The customer/tourist/user/travel agency is always required to inform the intermediary and the organizer of any particular needs or conditions they may have (pregnancy, food intolerances, disabilities, etc.) and to explicitly specify any request for related personalized services.
It is not possible to replace the customer/tourist/user who withdraws with another person. The replacement of a participant entails the cancellation of the booking.
Any changes requested by the customer/tourist/user/travel agency to bookings that have already been confirmed shall not be binding on Alltrade Business Srl where such changes cannot be accommodated. Requests for changes shall entail additional charges, to be agreed from time to time depending on the nature of the changes.
Alltrade Business Srl shall not be liable for any compensation for damages arising from cancellations or changes to travel services due to force majeure. Such events include, by way of example and not limitation, wars, terrorist activity, nationwide strikes, fires, epidemics, hurricanes, and other actual or potential serious environmental disasters.
Any failure in the performance of the contract must be reported by the tourist during the use of the service by promptly submitting a complaint, so that Alltrade Business Srl or its local representative may remedy it without delay. Failing this, compensation for damages may be reduced or excluded pursuant to Article 1227 of the Italian Civil Code.
The tourist must also, under penalty of forfeiture, submit a complaint to the organizer or intermediary no later than 10 working days from the date of return to the place of departure, by registered letter with acknowledgment of receipt or by any other means providing proof of receipt, such as email to alltradebusiness@pec.it.
The travel organizer or intermediary shall be released from the duty of assistance where the non-performance or improper performance of the contract is attributable to the tourist, or is due to the act of a third party of an unforeseeable or unavoidable nature, or was caused by an unforeseeable event or force majeure.
Here is the English translation:
“Pursuant to art. 32, para. 2 of the Tourism Code, the tourist is hereby informed of the exclusion of the right of withdrawal provided for by arts. 64 et seq. of Legislative Decree no. 206/2005 (Consumer Code).”
